Orders and Shipments

All orders:

  • are subject to acceptance by Hawthorn Pharmaceuticals, Inc. (HAWTHORN).
  • must be faxed, mailed, or e-mailed . Telephone orders will not be accepted.
  • must be in minimum case quantities (see catalog case pack reference).
  • shipping to destinations within the continental U.S. totaling $500 or more will be shipped prepaid.
  • shipped prepaid, HAWTHORN selects the method of transportation. If a more expensive method of transportation, or special handling is requested (which requires written confirmation), HAWTHORN reserves the right to charge the customer for these expenses.

Payment Terms

  • Net 30 days unless otherwise specified on the invoice.
  • Account is considered delinquent after the net payment date. The entire balance on account is immediately due and payable when delinquent. At such time all current order(s) may be held for shipment.
  • Payments 30 days past due will be charged a 1.5% finance charge on the gross invoice balance from the date of the purchase.
  • New customers may be required to pay in advance, or a deposit may be required at the discretion of HAWTHORN management. Credit on account is authorized following a financial reference review.

Insurance

  • A Certificate of Product Liability Insurance will be made available upon written request.

Non-returnable Items

  • Product that has not passed its expiration date.
  • Product more than twelve (12) months past expiration date.
  • Product sold on a non-returnable basis.
  • Product with broken seals, opened or soiled packages.
  • Product damaged at the customer’s warehouse or store level.
  • Product stored under improper conditions or exposed to fire, smoke, water or other adverse environmental conditions.
  • Outdated returns totaling $25.00 or less.

Returnable Items

Outdated and Damaged Goods

  • Expired product in sealed, original HAWTHORN container (no
    partials).
  • Expired product, but not more than twelve (12) months past expiration date.
  • Concealed damage claims made within 60 days of receipt.
  • Products damaged in shipping to consignee accompanied by a signed bill of lading noting such damage. (Claims must be made within 10 days.)

Other Returnable Goods

  • Products must have a minimum of thirteen (13) months dating remaining. Credit will not be given until product is returned to HAWTHORN and deemed resalable by HAWTHORN. Other returnable goods are subjected to a 25% restocking fee.

Procedure for Returning Items

  • All requests for returns must be in writing. Mail or fax quantity, NDC number, lot number, expiration date, full or partial status and reason for return. After review, a return authorization number (RA#) will be assigned if warranted.
  • Place the RA# on the outside of all packages. Returns without the RA# will not be accepted by HAWTHORN.
  • Credit will not be given for any additional items returned without authorization.
  • Returns are subject to a restocking/handling fee (25%).
  • Customer is responsible for processing fees.

Transportation

  • Customer is responsible for all shipping/freight charges, unless shipped in error by HAWTHORN.
  • Returned product shipped collect will be refused.

Credit

  • All expired product returned in unopened containers up to one year past expiration date in accordance with and subject to the other terms and conditions set forth herein will be credited at current wholesale prices except for returns from a customer who is receiving contract prices. Credit, in these instances, will be issued at the contract price in force at the time the returns are received. Credit will be issued based on unit count received at our warehousing sites.
  • HAWTHORN will not be responsible for fees associated with outside or third-party processing companies.

Disclaimer

HAWTHORN products received by HAWTHORN not meeting the above guidelines will not be returned and credit will not be issued. These policies are subject to applicable state and/or other regulatory agency’s regulations.
